1.9 Subdivision 1. In line of Duty disability; computation of benefits. (a) A member

353.651,
1.12 subdivision 1, or
1.13 (2) has met the requirements for a retirement annuity under section
353.651,
1.14 subdivision 1, but who does not have 20 years of credited service; and who becomes
1.15 disabled and physically unfit to perform duties as a police officer, firefighter, or paramedic
1.16 as defined under section
353.64, subdivision 10, as a direct result of an injury, sickness, or
1.17 other disability incurred in or arising out of any act of duty, which has or is expected to
1.18 render the member physically or mentally unable to perform the duties as a police officer,
1.19 firefighter, or paramedic as defined under section
353.64, subdivision 10, for a period of at
1.20 least one year is determined to qualify for duty disability as defined in section 353.01,
1.21 subdivision 41, shall receive disability benefits during the period of such disability.
1.22 (b) The benefits must be in an amount equal to 60 percent of the "average salary" as
1.23 defined in section
, plus an additional percent specified in section
1.24 356.315, subdivision 6, of that average salary for each year of service in excess of 20 years.
1.25 (b) To be eligible for a benefit under paragraph (a), the member must have:
1.26 (1) not met the requirements for a retirement annuity under section 353.651,
1.27 subdivision 1; or
1.28 (2) met the requirements under that subdivision, but does not have at least 20 years
1.29 of allowable service credit.
1.30 (c) If paragraph (b), clause (2), applies, the disability benefit must be paid for a
1.31 period of 60 months from the disability benefit accrual date and at the end of that period
1.32 is subject to provisions of subdivision 5a.
1.33 (d) If the disability under this subdivision occurs before the member has at least five
1.34 years of allowable service credit in the police and fire plan, the disability benefit must be
1.35 computed on the "average salary" from which deductions were made for contribution to
1.36 the police and fire fund.
2.1 EFFECTIVE DATE.This section is effective July 1, 2007, and applies to disability
2.2 benefit applicants whose last day of public employment was after June 30, 2007."

1.6 shall adopt standards prescribing specific detailed methods to calculate, evaluate, and
1.7 display current and proposed law liabilities, costs, and actuarial equivalents of all public
1.8 employee pension plans in Minnesota. These standards shall be consistent with chapter
1.9 356 and be updated annually. The standards must not contain a valuation requirement that
1.10 is inconsistent with generally accepted accounting principles applicable to government
1.11 pension plans."
