  1.7  356.41, whichever applies." 

  1.8     Page 14, after line 6, insert: 

  1.9     "Sec. 11.  354A.281 MTRFA BASIC PROGRAM; POSTRETIREMENT 

  1.10 ADJUSTMENTS.

  1.11    Notwithstanding any provision of this chapter, the articles

  1.12 of incorporation of the Minneapolis Teachers Retirement Fund

  1.13 Association, or the bylaws of the Minneapolis Teachers

  1.14 Retirement Fund Association to the contrary, postretirement

  1.15 adjustments to any benefit recipient of the basic program of the

  1.16 Minneapolis Teachers Retirement Fund Association are provided

  1.17 solely under section 356.41 and may not exceed five percent

  1.18 annually." 

  1.19    Page 17, after line 23, insert: 

  1.20    "(a) Sections 1 to 16 are not effective unless the

  1.21 Minneapolis Teachers Retirement Fund Association amends its

  1.22 articles of incorporation and bylaws on or before July 1, 2005,

  1.23 to eliminate the automatic two percent annual postretirement

  1.24 increase provided for in the articles of incorporation and

  1.25 bylaws and to eliminate any additional postretirement increase

  1.26 attributable to the investment performance of the Minneapolis

  1.27 Teachers Retirement Fund Association.  In accordance with

  1.28 Minnesota Statutes, section 356A.12, subdivision 4, approval is

  1.29 granted for the Minneapolis Teachers Retirement Fund Association

  1.30 to amend its articles of incorporation and bylaws as provided in

  1.31 this paragraph.

  1.32    (b)"
