1.1 A bill for an act
1.2 relating to retirement; Public Employees Retirement
1.3 Association; authorizing the payment of interest on
1.4 prior service credit purchase payment overages by
1.5 former Minneapolis Community Development Agency
1.6 employees; permitting a return of a prior service
1.7 credit purchase payment for certain Minneapolis city
1.8 employees.
1.9 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.10 Section 1. PUBLIC EMPLOYEES RETIREMENT ASSOCIATION;
1.11 INTEREST ON SERVICE CREDIT PURCHASE PAYMENT RETURN.
1.12 If a former employee of the Minneapolis Community
1.13 Development Agency made a prior service credit purchase payment
1.14 under Minnesota Statutes 2002, section 356.55, in an amount that
1.15 is greater than the actually required payment amount because of
1.16 the use of an inaccurate salary figure or other similar
1.17 reporting or clerical error, the general employees retirement
1.18 plan of the Public Employees Retirement Association may pay
1.19 interest on the overage amount at an annual compound rate of six
1.20 percent per year.
1.21 Sec. 2. RETURN OF PRIOR SERVICE CREDIT PURCHASE PAYMENT
1.22 FOR CERTAIN MINNEAPOLIS CITY EMPLOYEES.
1.23 (a) An eligible person, upon written application, may
1.24 receive a return of a prior service credit purchase payment
1.25 under Minnesota Statutes 2002, section 356.55, plus interest on
1.26 the amount at an annual compound rate of six percent per year.
1.27 The return amount and interest must be made in an
2.1 institution‑to‑institution transfer to a federal tax qualified
2.2 retirement plan or account and may not be paid directly to an
2.3 individual.
2.4 (b) An eligible person is a person who was an employee of
2.5 the Minneapolis Community Development Agency and made a payment
2.6 for the purchase of prior service credit under Laws 2003,
2.7 chapter 127, article 12, section 31, subdivision 4, and
2.8 Minnesota Statutes 2002, section 356.55, in an erroneous amount
2.9 because of an inaccurate salary figure supplied by the employing
2.10 agency.
2.11 Sec. 3. EFFECTIVE DATE.
2.12 Sections 1 and 2 are effective on the day following final
2.13 enactment.
