1.5 subdivision 1, is amended to read:
1.6 Subdivision 1. POWER OVER FUNDS. (a) The members of the
1.7 retirement board shall be the trustees and custodians of the
1.8 several funds created by sections 422A.01 to 422A.25 and shall
1.9 have exclusive control and management of these funds, and power
1.10 to invest them and to hold, purchase, sell, assign, transfer, or
1.11 dispose of any of the securities and investments in which any of
1.12 the funds created by sections 422A.01 to 422A.25 shall have been
1.13 invested as well as the proceeds of the investments, and of the
1.14 money belonging to these funds.
1.15 (b) The power to manage and invest the assets of the funds
1.16 must be exercised by the retirement board solely through
1.17 professional investment or property management firms that are
1.18 independent of the retirement fund. No financial or property
1.19 assets of the funds may be managed, serviced, or invested
1.20 internally or in‑house at the retirement fund, except that any
1.21 investment held by a fund on February 1, 1993, that is not
1.22 readily tradable on an established securities exchange may
1.23 continue to be managed directly by the retirement board until
1.24 the investment is converted to cash. The retirement board's
1.25 functions under this section consist primarily of establishing
1.26 and effectuating investment policy and structure, managing the
1.27 investment process, monitoring and measuring the performance of
1.28 the external independent professional investment or property
1.29 management firms, retaining or terminating agreements with these
1.30 firms, apportioning the assets of the funds to be managed among
1.31 these firms, and making financial decisions on issues if
1.32 approvals have been specifically reserved by and to the board.
1.33 (c) The board may contract with the board of trustees of
1.34 the Public Employees Retirement Association to perform the
1.35 administrative duties related to the plan."
